By using AeroChat's services, you agree to comply with and be bound by these Terms of Use, as well as our Privacy Policy. These terms apply to all visitors, users, and others who access or use our services.

AeroChat grants you a limited, non-exclusive, non-transferable license to access and use our services for personal or business purposes in accordance with these Terms of Use. This license does not include the right to modify, distribute, or reproduce any content from our services without our prior written consent.

5. Payment and Fees

5.1 Billing
Certain features or services offered by AeroChat may be subject to fees. If you elect to use paid features, you agree to pay all applicable fees as described at the time of purchase. AeroChat may change its pricing and payment policies at any time, with notice provided to you if such changes affect existing subscriptions or services.

5.2 Refunds
Refunds for any fees paid are subject to AeroChat’s refund policy. All sales are final unless otherwise stated in the terms of the specific service or feature.

6. Termination

6.1 Termination by You
You may terminate your account at any time by contacting AeroChat’s support team. Upon termination, your right to use the services will immediately cease, and AeroChat will delete or deactivate your account and associated data as outlined in our Privacy Policy.

6.2 Termination by AeroChat
AeroChat reserves the right to suspend or terminate your access to the services at any time, with or without notice, if you breach these Terms of Use or if we determine that your actions may cause harm to other users, third parties, or AeroChat.

7. Disclaimers and Limitation of Liability

7.1 No Warranty
AeroChat’s services are provided “as is” and “as available,” without any warranties of any kind, either express or implied. AeroChat disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

7.2 Limitation of Liability
To the fullest extent permitted by law, AeroChat and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or related to your use of the services, even if AeroChat has been advised of the possibility of such damages.

8. Indemnification

You agree to indemnify, defend, and hold harmless AeroChat and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney’s fees, arising out of or related to your use of the services, your violation of these Terms of Use, or your violation of any rights of another party.

9. Governing Law and Dispute Resolution

9.1 Governing Law
These Terms of Use and any disputes arising out of or relating to them shall be governed by the laws of Singapore, without regard to its conflict of laws principles.

9.2 Dispute Resolution
Any disputes arising out of or relating to these Terms of Use or your use of AeroChat’s services shall be resolved through binding arbitration in Singapore, in accordance with the rules of the Singapore International Arbitration Centre (SIAC). The arbitration shall be conducted in English, and the arbitrator’s decision shall be final and binding.

10. Miscellaneous

10.1 Entire Agreement
These Terms of Use, along with our Privacy Policy, constitute the entire agreement between you and AeroChat regarding your use of the services and supersede any prior agreements or understandings.

10.2 Severability
If any provision of these Terms of Use is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

10.3 Waiver
No waiver of any term or condition of these Terms of Use shall be deemed a further or continuing waiver of such term or condition or any other term or condition.
